  • Greater certainty on expropriation imminent

Greater certainty on the content of the imminent change to the wording of Section 25 of the Constitution to give explicit meaning to the state’s power to expropriate property without compensation has emerged after a week of often heated debate and input in parliament.

  • A Cheshire Cat and Two Red Herrings – what ‘nil’ compensation is likely to mean in practice

Last week the Ad Hoc Committee responsible for drafting an expropriation-without- compensation (EWC) constitutional amendment bill (the EWC Bill) invited three ministers, including minister of mineral resources and energy Gwede Mantashe, to put forward their comments on its draft to date.

  • The expropriation without compensation concerto reaches a climax as we enter the final movement

In the official announcement, land expropriation committee chairperson Dr Mathole Motshekga said this clears the way for the committee to start engaging and deliberating on the “wording and format” of the 18th Constitutional Amendment Bill. He continued:

  • The calm before the storm?

Expropriation Without Compensation – have South Africa’s citizens merely dodged the bullet?

  • Definition of expropriation – a risk that should not be ignored- South Africa

The Expropriation Bill is currently before the Portfolio Committee on Public Works and Infrastructure.

  • South Africa May Soon Take Land Without Compensation

South Africa’s National Assembly passed a bill on Sept. 28 that would allow the government to seize land without paying the owners, a practice known as ‘expropriation without compensation.’

  • Read between the lines to understand the pernicious Expropriation Bill

In a well-meaning and thoughtful piece (‘Putting the Expropriation Bill into perspective – it’s not the ugly ogre some make it out to be’) Annelize Crosby argues in the Daily Maverick that many of the concerns with the 2020 Expropriation Bill are overblown.

  • The new Expropriation Act: South Africa’s chance to face its imperial past

The executive order of Donald Trump to terminate American aid funding for South Africa is a grave distortion of the law and of history.

  • Wandile Sihlobo is too bullish on the Expropriation Act - South Africa

The nature and history of the African National Congress (ANC) cannot be discounted when reading the text of the new Expropriation Act.

  • 40 000 white farmers own ‘half of South Africa

South Africa is a global example of how not to redistribute land. It’s a failure.

  • Renewed thrust for land reform measures – expropriation, land ceilings, land register?

The debate on land reform in South Africa does seem like a case of the same proposals coming around again and again.

  • WEEKEND-VIEWPOINT- Land Access Threat. South Africa

Across the globe, countries like England, Germany, Australia, the USA, and South Africa are grappling with complex challenges surrounding immigration, integration, and societal cohesion.
  • WEEKEND-VIEWPOINT- Slow Land Reform Spark Farmer Frustration in South Africa and a Masterplan without Farmers.

At the Land, Life and Society conference in Bellville-South (Oct 7, 2025), Minister Mzwanele Nyhontso acknowledged that South Africa’s land reform program since 1994—focused on restitution, redistribution, and tenure reform—has transferred millions of hectares and secured rights for families and communities but falls short.
  • WEEKEND-VIEWPOINT- Why Biosecurity is Failing and FMD Persists

It's heartbreaking to see South Africa's livestock farmers battered by yet another foot-and-mouth disease (FMD) outbreak, with biosecurity failures letting the virus run rampant.
  • WEEKEND-VIEWPOINT- The 5th Junior Agri Writers Awards Celebrates Young Voices in Agriculture

The Junior Agricultural Writers awards in South Africa marked a significant milestone with the 5th Junior Agri Writers Awards, held at Hollard’s prestigious head office in Parktown, Johannesburg.
  • Getting real about land reform and confiscation

Last week a case-study of mine on expropriation without compensation in South Africa appeared in the 2025 International Property Rights Index. This column is a summary of that study, which can be read in full here.
